Whole Foods Avoids Oatmeal Label Suit Over Sugar, Grain Content

Whole Foods oatmeal buyers failed to plausibly allege that the high-end grocer’s “Oats & Flax Instant Oatmeal” could fool consumers about the product’s sugar or whole grain content, a New York federal court said.

Even if the plaintiffs’ theories of deception were plausible, the ingredient list would dispel any confusion, the U.S. District Court for the Eastern District of New York said.

Amy Warren and Iesha Conley alleged Whole Foods Market Group Inc. hid sugar in its 365 Everyday Value brand cereal by calling it “dehydrated cane juice solids.” They also said a “100% Whole Grain – 18g or more …
